Cadence90 Cycling and Tours LLP herein called Cadence90 who is the Organizer requires the participant to read the below mentioned terms and conditions before registration and it is assumed that he/she has accepted the terms and conditions and will abide by the same upon completion of the registration formalities.
As a participant of this cycling tour, I agree as follows:
I acknowledge and agree that Cadence90 offers this tour called Tour of Karnataka, a multi day cycling tour on the understanding that they are a common adventure that all riders conduct themselves independently, make their own judgments about their safety and contribute what they can to the success of any activity in which they participate. Neither the officers nor any of the riders of Cadence90, including activity organisers and leaders are professionals. They act only in regard to initiating, organising and making basic arrangements for this tour which is a Cadence90 activity.
I acknowledge that the Event takes part in public roads which are not controlled, the entire route of the tour will have all kinds of motorised and non motorised traffic, pedestrian traffic, animals, natural and artificial hurdles. The roads can be of different terrain, from good conditions to the other extreme of certain stretches having no road.
I agree to ensure I have the necessary equipment, skills, health and level of fitness to take part safely in this cycling tour that I am participating in. I also agree to exercise common sense while participating in this cycling tour.
I accept that should any medical or physical condition arise prior to the Event which is likely to affect my ability to participate, I will withdraw in accordance with these Conditions.
I recognize that financial loss, physical injury or even death is a conceivable consequence of participation in the Tour of Karnataka. I agree to be the sole and final judge of my ability to participate safely in this cycling tour and to assess, assume and accept all of the potential risks, dangers and hazards (including the possibility of personal injury, death, property damage or loss) that may arise as a consequence of my participation in this cycling tour.
I agree that if I experience an injury or illness while participating in this cycling tour, either or both Cadence90 and any of its riders may apply for or seek medical aid on my behalf, where such injury or illness may so require. I further agree to be financially responsible for that aid.
While I am participating in this cycling tour, if either or both Cadence90 and any of its riders have reasonable cause to believe I am in need of the assistance of search or rescue operations, or both of them, I agree they may request such operations on my behalf and I further agree to be financially responsible for any costs associated with such operations. I agree to hold harmless and indemnify Cadence90, its officers, riders and functionaries (including but not limited to organisers and leaders) from any and all liability for property damage, personal injury or death suffered by me and from any and all costs associated with any medical aid, search operations or rescue operations conducted on my behalf that may arise in relation to my participation in this cycling tour.
I take full responsibility for my own safety during the period of COVID19 pandemic or novel coronavirus and assume all the risks of participating in this event and I waive, release and forever discharge Cadence90 Cycling And Tours LLP, its constituents and its assigned associates from any and all liability for my death, myself contracting infection, spreading infection to others, hospitalisation and any financial expenditures thereof. I will take all safety precautions of carrying & wearing mask, carrying & using hand sanitiser, maintaining social distancing and following all guidelines issued by local, state & central authorities including Ministry of Home Affairs.
I will permit free use of my name, pictures and videos from the event in media broadcasts, print and television etc. This waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I hereby certify that I have read this document and understand its contents.
I accept that I am not entitled for a refund of the Fees if I am disqualified from the Event as a result of an infringement of these Conditions or any such rules and regulations. The Event Organiser is also entitled to impose Event rules upon the Participant from time to time which will form part of these Conditions.
1. The Organiser may introduce cut off times everyday during the tour as a part of the Event rules, on the time taken to complete sections of the Event to ensure safety and proper running of the Event. Subsequently, participants may be instructed to withdraw from the tour in accordance with these imposed cut off times.
2. The Organiser reserves the right at any time to remove or change any section of the tour due to unforeseen circumstances like rain, wild animal movements and any other clearance issues.
3. The Event Organiser reserves the right at any time to remove participants from the Event or prevent participants participating in the Event if the participant has acted negligently, maliciously, with wilful misconduct or otherwise without due care and attention for the Event or other participants, so as to cause his/her removal.
4. At the time of registration, the participant must produce an appropriate photographic personal identification acceptable to the Event Organiser (such as drivers licence or passport).
5. While the Event Organiser takes every care with the staging of the Event, the Participant acknowledges that personal accident and personal items insurance is his or her sole responsibility. The participant shall purchase at his/her own costs appropriate insurance policy so as to cover any and all claims for loss or damage to life, property of self or others. This also includes bicycle transportation. Utmost care is taken to transport the bicycles, in spite of that, if there is any damage to the bike the Organiser is not responsible for the same.
6. The Organiser reserves the right to change the date of the Event. Should a change of date be made, and the Participant is unable to attend on the revised date, he/she has two weeks to inform the Event Organiser in writing from when the change in date is announced to receive a refund of their Entry Fee.
Refund Policy:
The Participant may withdraw from the event at any time, subject to the following.If the Participant withdraws from the Event
Before July 31st, 2022; 70% of fees will be returned.
Before September 30th, 2022; 50% of the fees will be returned.
On or after October 1st, 2022; participant forfeits his/ her place in the event; there will be no refund.
All decisions and rulings by the Organiser, its employees and its agents are considered final. Accordingly, the Participant will comply with all Event rules and all instructions and guidelines given by stewards, marshalls, and safety personnel.
I acknowledge and agree that the Organiser will have the sole authority and will be the final arbiter on all decisions relating to the safety, running and organisation of the Event, the rules of the Event, the timings/finish times and the placings.
I represent and warrant that the Entry is purchased for personal use only and it cannot be donated free of charge or otherwise given away for free. I also understand that it is not transferable.
I accept that my participation is confirmed only after the payment of 100% is made. I also accept that I am not eligible to take part in the event unless the 100% payment is made.
Any dispute/s and/or claim/s arising out of this contract shall be subject to the exclusive jurisdiction of the Bangalore Courts only.
I agree to abide by all applicable rules and regulations of the Event.
